To the dismay of landlords and real estate groups, eviction moratoriums have been extended, this time through October 3, 2021.
The Center for Disease Control and Prevention (CDC) issued the new order that pertains to areas that are experiencing an increase in coronavirus cases, acknowledging the more imminent danger emanating from the spread of the Delta variant across the country. Qualifying areas include 80% of U.S. counties; all of New York City is included.
New York City launched the ERAP program a month ago to help with rent payments, but allocation of the money hasn’t been efficient. Many landlords think this extension is illegal as it puts them in further financial risk, and likely the law will face lawsuits challenging its constitutionality. However, President Biden is willing to break oath and go to the full extent of the law in order to defend millions of families. Individuals and families are already in financial danger and with an explosion of evictions may be further vulnerable to homelessness and even riskier exposure to the Delta variant.
